第四次江陳會即將登場，台中市政府、台中市警察局、執政黨、在野黨與各種「異議份子」已準備好在這個會談中大展身手。從胡自強市長對民眾抗議的憂慮以及台中市警局未雨綢繆的「預告停業」的通知諸多行動來看，本次江陳會將再次檢視台灣的民主與法治基礎。無法否認的，去年底的江陳會將台北帶入一種舊時代的氛圍，讓民主社會中所保障的言論自由、居住自由、集會與遊行自由顯得破碎不堪。我們相信第四次江陳會也是檢視台灣民主與法治實踐的一個重要事件，由於上述的基本自由對於民主政治以及個人的人格塑造與自我實現具有基本重要性，我們希望重新闡述基本憲政觀，促進更廣泛地公共思辯。觀看全文...
最近的身體真是很不好，上一個感冒剛好，下一個便趕來見面。這次的感冒很奇怪，喉嚨會很痛，在初期無法說話，害得我只能停課。上次欠的課尚未結清，卻又欠下新的債。不知道該怎麼還？

This information is received by me through the e-mail. It’s a little pity for me missing the registration on the first workshop. To know the history and the meaning from the view point of international human rights movements is very interesting. However the second workshop is kind of general introduction on the two covenants. This blog was found by me several days ago. And I think it’s one of the serious blogs focusing on the legal theory. The blog is the “Legal Theory Lexicon” introducing the basic concept in the political and legal theory. The lexicon kind like this is easy for those who want to learn legal philosophy. However the most important is the lexicon is just the starting point for our understanding not the ending point. Its explanation in each concept is the guide for us to dig out the more deep thought. 莫拉克颱風重創台灣，其重創的不僅是南台灣的自然環境與人民，更重創了馬政府的民調，或許正因為被批評對災情掌握不足與救災反應過慢，使得馬總統在救災行動尚未完全結束時便已宣示要以重建為第一考量，而行政院院會已通過「莫拉克颱風災後重建特別條例」草案（以下簡稱重建條例），立法院也預計召開臨時會加速審查。當我們審視重建條例後發現，這裡面蘊含著諸多粗糙的立法技術，致使過度排除一般法律管制；許多規定也可能嚴重違反憲法之基本權保障與國家目標義務之憲政理念，更可能造成法治危機。身為台灣公民社會一份子，我們願意就以上幾點表達意見，期能藉由公共對話讓遭受莫拉克颱風肆虐的災民能真正獲得「重建工作」的利益，而非因重建而造成法政社經地位的再次弱化。觀看全文...
