Qualcomm才剛跟Skyworks Solutions Inc.和解，又來了ITC，Qualcomm這夏天真是超忙。
看來，通訊技術的專利戰爭好有得打。

What kind of girl are you?
You're like me! The intelligent loner. You're shy
at times but friendly, and you are never weak

Hitachi v. three Taiwanese manufacturers
在Hitachi Ltd. filed a patent suit against three major Taiwanese monitor manufacturers & their American divisions--Pierce Law IP Nws Blog看到的消息，Hitachi是在6/6/2005向U.S. District Court of Northern California提出的。

Where's the rest of the music come from?
這下終於有人算出來了！:twisted:呼應之前的post“iPod的玩家們都是數位音樂的小偷？”
原來每個幾乎平均每一台iPod只有21首從音樂商店買來的音樂呀？
儘管，iPod還兼具硬碟功能，確實不能肯定剩下的空間都是裝盜版音樂，不過，一個iPod通常都不會只有21首歌曲就是了。不過這數據，最肯定的一件事，就是iTune音樂商店，還不是現在大眾購買音樂的主要管道。我們（或者應該說是音樂界）仍然可以懷抱一絲幻想，大家都是去買了整張正版CD再回家存在iPod裡的。:?:
話說回來，iTune音樂商店一首單曲定價一塊美金，Rit@覺得還算合理。畢竟一張專輯又不是每一首都喜歡，怎能強迫人家要把專輯中為了湊成10首這吉祥數字用的曲目也一起買呢？另外，iTune音樂商店的音樂最好還是要適用所有MP3播放器才比較好，比較公平吧？

由於MercExchange與eBay等多家公司間之專利侵權爭訟，使得eBay等被告企圖向Supreme Court要求裁決MercExchange這種有如"Patent Trolls"的行為。
eBay指稱，有些小公司就是因為得到專利，卻默不作聲，也不將此專利實施，直到有一天有大公司實施了其專利內容，這些專利權人再向實施這些專利的公司獅子大開口。而MercExchange則指稱，他們確實有意要實施所擁有之專利技術，但是他們還需籌措資本。

事實上，Supreme Court會不會聽這案子，還不知道，不過如果真如eBay所主張，只要專利權人不實施專利內容，就不能主張其專利權?這樣跟專利本身的標的似乎是說不過去的。
以專利本身來說，發明人所獲得的是一"排他權"，也就是"僅能排除他人實施其專利內容"的權利。這當中，並不包含"實施權"，因此專利權人，並沒有義務，也沒有被保證一定可以施行其專利內容。所以eBay的主張在這邊看來，並不有力，而MercExchange也無需證明其有意圖要實施其專利內容。
另一方面，若要使得MercExchange的專利unenforceable，要至少是inequitable conduct、patent misuse、laches、antitrust counterclaims 和 equitable estoppel 要至少是其中一種。如果eBay能說服法官，MercExchange確實是"unreasonable, improper and undue delay'，才有可能以laches為由，達成unenforceable的判決。
此外，在Patent Troll-Be-Gone? [by Overlawyered]中， 也提到了"calling for a change in patent law so that owners who are not using their patents would no longer have the right to sue for injunctions against alleged infringers''也提到了，要做這種改變，亦對專利法有相當影響，目前在很多支持者間，都還擺不平呢!
