Recent years have seen an extraordinary number of political activists and human 

rights defenders extra-judicially killed in the Philippines. Reports indicate that ap-

proximately 290 such persons have been killed since 2004. These figures and the 

current situation in the Philippines are entirely unacceptable and require urgent 

intervention by the Government if the killings are to stop.

近幾年在菲律賓一直看到異常多的政治積極者和人權鬥士非經司法途徑就

被殺害。報告指出，2004 年以來大約殺害了290人。我們完全不能接受這

些數字和菲律賓當前局勢，我們要求政府立即干預，中止殺害。

The unabated killings and attacks against activists in the Philippines have revealed 

a completely inadequate response by the government to prevent further deaths and 

to remedy this worsening situation. The police’s responsibility in investigating these 

cases has fallen completely short of what is required, resulting in the perpetrators, 

in most cases, having yet to be prosecuted in a court of law. This lack of an effect-

ive police investigation into the killings and violence against activists and the Gover-

nments seeming unwillingness to properly intervene are the greatest obstacles in 

prosecuting the perpetrators and bringing an end to these deaths.

對於未稍減的殺害和襲擊政治積極者，菲律賓政府完全沒有恰當防止更多

的死亡和惡化。警察在調查這些案子完全沒有盡到應盡的責任，沒有使得

多數案子的兇手被起訴。警察對殺害或以暴力打擊政治積極者的調查沒有

成效，政府也似乎不情願依規定地介入，是檢控兇手與終止這些死亡的最

It appears that in the Philippines no system exists to properly ensure that perpetr-

ators of serious crimes may be brought to justice for their actions. One of the basic 

elements of investigation, the gathering of evidence, appears to be non-existent in 

the Philippines right now. In most of the cases involving the killings of activists, this 

inability to properly gather evidence has meant that the perpetrators have not even 

been identified or persons who were present are so afraid that they are unwilling to 

be witnesses. Owing to this, many of the cases have not even made it to a court of 

law.

看起來在菲律賓沒有一個系統依規定保證重案犯罪者會因為他們的犯行而

歸案。調查的一個基本要件，蒐集證據，看來在當前的菲律賓並不存在。

涉及殺害政治積極者的多數案子都無能依規定蒐集證據，這意謂兇手根本

未被指認或是在場者害怕而不願意當證人。因此，許多案子根本到不了法

庭。

The failure to implement an effective investigation and a functioning witness 

protection mechanism appear to be major obstacles in bringing justice to cases 

of extra-judicial killings. Remedying this would require the effective implementation 

of the Republic Act 6981, an act providing for witness protection, security and 

benefit, including protection for activists who are facing threats to their lives. This 

would be extremely beneficial to all activists and human rights defenders who 

currently face such fears.

未能建立有成效的調查和有效的證人保護機制看來是正義審結非經司法途徑

的殺害案件之主要障礙。彌補這一點就需要實際實施共和國行動法第6981號，

它提供證人保護、安全和好處，也包括保護受生命威脅的政治積極者。這對

The Government of Philippines has failed to respond to the concluding observations 

and the recommendations made by the Human Rights Committee of the United 

Nations on 1 December 2003. The Government is obligated to take appropriate 

action, as State party to the International Covenant on Civil and Political Rights 

(ICCPR), to the Committee’s conclusion and recommendation that reads;

菲律賓政府未回應聯合國人權委員會在2003年12月1日提出的結論判斷和

建議。如同國家對公民和政治權利的國際公約（ICCPR）有責任採取適當

行動那樣，政府對該委員會的結論和建議也有責任採取適當行動，其結論

No. 8. “ The Committee is concerned about the lack of appropriate measures to 

investigate crimes allegedly committed by State security forces and agents, in 

particular those committed against human rights defenders, journalists and leaders 

of indigenous peoples, and the lack of measures taken to prosecute and punish 

the perpetrators.”

第8條：「委員會關切沒有以適當措施調查有人控訴的由國家安全部隊和

人員犯下的罪行，特別是那些對人權鬥士、新聞記者和當地人中的領袖所

犯的罪行，並關切沒有起訴和懲罰那些犯罪者。」

(a)The State party should adopt legislative and other measures to prevent such 

violations, in keeping articles 2, 6 and 9 of the Covenant, and ensure effective 

enforcement of the legislation.

The Government’s failure to take adequate action in response to these recomm-

endations and to the killings themselves, are clearly depriving Filipinos of their 

right to life. Such action has terrorised and silenced the people, in particular those 

critical of the state, which is entirely unacceptable. It has also denied Filipinos of 

an environment where the basic rule of law exists.

政府沒有採取恰當行動以回應這些建議及殺害，就是明顯剝奪菲律賓人

的生命權。這樣的作為已然恐怖統治了人民，也使他們沉默，尤其是使

那些批評政府的人噤口。這是完全不能接受的。它也使得菲律賓人無法

生活於基本的法治環境。

To prevent further killings of activists and human rights defenders and to avert 

a new social crisis in the country, the government must take immediate action 

regarding these matters. First, and most obviously, full investigations and judicial 

inquiries must follow without delay, with a view to holding the perpetrators fully 

accountable for their crimes and making clear that this pattern of killings will not 

be allowed to continue. Secondly, witness protection must be given to all persons 

who have witnessed the crimes. Thirdly, the Commission on Human Rights of the 

Philippines must play an active role by coordinating its work with the National 

Bureau of Investigation, rather than waiting for other agencies to take the initiative, 

and by considering recommendations to indemnify the families of the dead. Fourthly, 

the Government must condemn and demand the retraction of statements by the 

armed forces listing groups as 'communist sympathisers'.

防止殺害更多的政治積極者及人權鬥士和避免國家新的社會危機，政府

一定得針對這些事立即採取行動。首先而且顯然，充分的查詢和司法調

查一定得毫無遲疑地做出來，同時要打算抓到對其罪行負有完全責任的

犯罪者，並確定這種殺人模式不再可以繼續下去。第二，一定得給目擊

此等罪行的每一人證人保護。第三，菲律賓人權委員會一定得扮演一個

積極角色，與國家調查局彼此協調，而不是等待其它機構先啟動；並考

慮補償死者家庭的建議。第四，政府必須譴責並要求軍方收回某些組織

是「同情共產主義者」的聲明。

Until these measures are taken, the perpetrators will remain free and the killings 

will undoubtedly continue. The Government of the Philippines must take action 

if this situation is to be averted.

除非採取上述措施，犯罪者將會逍遙法外而殺人也將會繼續下去。如果

不希望這個情況，菲律賓政府一定得採取行動。

As the Secretary of the Department of Justice I trust that you will be amongst
