台灣高等法院於28日上午二審判決司馬庫斯風倒櫸木案件的三位部落族人有罪，但刑期與罰金皆較一審減半。司馬庫斯部落頭目倚岕˙穌龍，特別從部落趕到法院來，對於這樣的結果，頭目強調部落拒絕接受有罪判決，但是絕不會灰心或放棄，必將繼續上訴到最高法院。倚岕頭目也表示，部落不排除以「集體自首」的方式，共同捍衛部落傳統領域與習慣規範。
捍衛司馬庫斯行動聯盟、泰雅爾族民族議會、
泰雅族司馬庫斯部落三名青年，依《原基法》所承認與保障的泰雅族Gaga(暫譯規範)，經部落集體決議後，將因颱風倒塌阻礙部落唯一聯外道路之風倒櫸木搬運至路旁，並將其部份殘枝帶回作部落美化之用，結果被判竊盜罪。而林務局在部落自行搶通道路後，不聲不響地先行鋸走該風倒櫸木最有價值的樹身，其違反泰雅族Gaga、違反《原基法》、侵犯原住民族權利的行為，卻從未被處理！！櫸木事件當事人之一的Amin長老 (漢名：余榮明)即表示，今天的有罪判決，即使刑責減輕，仍充分顯示台灣司法體系與執法人員對於原住民族缺乏認知，對於《原基法》缺乏理解，也顯示台灣政府要能落實日前剛通過的《聯合國原住民族權利宣言》，就得好好做功課。
泰雅爾族民族議會指出，櫸木事件的整個過程，不僅凸顯行政機關漠視法律、不尊重原住民族，立法機關修法怠惰，連司法機關都無法維護原住民族基本權益，難怪原住民族對所謂的「新夥伴關係」產生強烈懷疑。鄒族民族議會代表汪明輝教授也指出，櫸木事件泰雅族人被判竊盜，就像幾年前鄒族頭目為了捍衛領域被判搶奪一樣；而台灣的國家法律實在讓原住民族覺得非常錯亂，一面通過《原基法》尊重原住民族對其傳統領域的管理使用，一面又適用舊有的普通法律予以限制，造成原住民族於其傳統領域上履行文化權卻被視為有罪的荒謬結果。
台灣人權促進會 秘書長林淑雅進一步談到，《原基法》通過，是回溯地承認原住民族集體權利，因此，原住民個人行為如果符合所屬民族的習慣規範（在傳統領域內、遵守部落的採集利用規範），就不會是違法行為；這也是《森林法》第十五條規定原住民族有權在傳統領域內依其生活慣俗取用林產物的重點所在。今天的判決，不僅違背《原基法》、《森林法》對原住民族集體權利的保障，也違背《原基法》第三十條司法機關應尊重原住民族習慣規範的規定。所以，「族人行為不違法」，而是「判決違法」，部落當然可以上訴到最高法院。
代表保育團體發言的蠻野心族生態協會秘書長林子淩譴責說，今天的判決是一個醜陋的妥協。因為，如果法院認定三人有罪，那麼根據《森林法》，結夥並使用搬運設備竊取林產物，應加重判刑，為何法官卻做出減輕刑責的判決？如果法官已體認到原住民族價值系統中人對自然的善待、和諧、永續與責任，為何沒有勇氣做出無罪判決？
高等法院的有罪判決，雖然讓所有聲援團體感到遺憾，但是捍衛司馬庫斯行動聯盟、泰雅爾族民族議會、
